Relocation
of Children
One
of the realities of modern society is the likelihood of relocation
as a result of an individual's work or career goals. This is a particularly
delicate issue when faced by divorced couples sharing joint custody
of their children. For attorneys who practice family law, this process
is known as "child removal."
What
Does Child Removal Involve?
Child removal
cases occur if both parents have physical placement rights with a
minor child and one parent (who must also have either sole or joint
legal custody) wishes to either:
a) establish
his or her legal residence with the child at any location outside
Wisconsin;
b) establish
his or her legal residence with the child at any location within Wisconsin
that is at a distance of 150 miles or more from the other parent or
c) remove the
child from Wisconsin for more than 90 consecutive days;
a special procedure
must be followed, known as "removal," to notify the other parent of
those intentions and to provide the opportunity for that parent to
contest in circuit court the proposed removal.
