Paternity
is much more than just establishing fatherhood over a child. It can be an important
first step in determining child custody, physical placement and child support.
And, in certain cases, the life and health of a child may hang in the balance.
How
Does It Work?
Unlike a divorce action,
the parties to a paternity action are not married to each other. They must have
at least one child born or adopted into their relationship. Paternity
actions exclusively address issues relating to a child born or adopted into that
relationship, primarily: child custody, physical placement and child support.
If necessary, the parties
are ordered by the court to undergo genetic testing (typically a cheek swab) to
confirm or exclude paternity.
